These Terms apply to professional planning services provided by Explore Blue Travel for leisure and group travel, including solo vacations, couples vacations, family and friends trips, land vacations, all inclusive vacations, air and hotel packages, combination packages, multi destination vacations, cruises, pre cruise and post cruise arrangements, group vacations, transportation, tours, excursions, special occasion arrangements, and other travel related planning services.
Certain services, including Explore Blue Travel hosted group trips, retreats, or other specialized travel programs, may require a separate agreement containing additional terms.
If a separate written agreement applies to a specific trip or service, that agreement will supplement these Terms.
Payment of a professional planning fee authorizes Explore Blue Travel to begin providing professional travel planning services.
The planning fee purchases Explore Blue Travel's professional time, expertise, research, recommendations, coordination, and travel management services.
Payment of the planning fee does not purchase airfare, accommodations, cruise cabins, transportation, excursions, insurance, or any other travel component.
Travel arrangements are purchased separately after the client approves the applicable travel arrangements and completes any required authorization and payment.
Professional planning fees are separate from the cost of the vacation.
All professional planning fees are nonrefundable and nontransferable once paid and planning services have begun, except where otherwise required by applicable law or where Explore Blue Travel agrees otherwise in writing.
The planning fee remains nonrefundable if the client later decides not to travel, cancels the trip, changes destinations, chooses to book independently, stops responding, or receives a refund or travel credit from a travel supplier.
The amount of the planning fee is based on the service selected, number of travelers, number of cruise cabins when applicable, complexity of the trip, and anticipated level of planning and coordination.
The services provided will be based on the planning service purchased and the information supplied by the client.
Planning may include destination research, airfare research, hotel and resort recommendations, cruise research, cabin recommendations, ground transportation, tours, excursions, activities, special occasion arrangements, reservation coordination, payment reminders, supplier communication, pre travel information, and final travel documents.
The client's selected planning service does not provide unlimited research, unlimited revisions, unlimited destinations, or unlimited changes.
Travel needs that materially exceed the original scope may require an additional professional planning fee.
Additional professional fees may apply when a trip requires substantially more planning than a standard vacation.
Examples may include multiple countries, multiple destinations, multiple departure cities, extended travel periods, complicated airfare, numerous room configurations, large groups, custom events, extensive supplier coordination, or significant changes after research has begun.
Explore Blue Travel will notify the client of any additional professional fee before completing work that materially exceeds the original planning scope.
The client must approve the additional fee before that additional work begins.
When appropriate, Explore Blue Travel may provide up to three initial vacation options based on the client's stated destination, dates, budget, preferences, and travel needs.
Standard planning includes up to two reasonable revisions to the initial proposal before booking unless otherwise stated.
A reasonable revision generally means modifying an existing proposal while maintaining substantially the same destination, travel period, budget, and overall trip concept.
Changing the destination, significantly changing the travel dates, substantially changing the budget, adding destinations, changing the primary departure airport after airfare research has begun, substantially increasing the number of travelers, or requesting an entirely new vacation concept may constitute a new planning assignment rather than a revision.
Once travel has been booked, requested modifications are considered reservation changes rather than proposal revisions.
Travel pricing and availability can change quickly.
Clients are responsible for reviewing proposals and responding within a reasonable period of time.
Explore Blue Travel does not guarantee that pricing or availability presented in an earlier proposal will remain available if the client delays making a decision.
If a client stops responding during the planning process, Explore Blue Travel may place the planning file on hold or close the planning file after providing reasonable notice.
If substantial new research is required when the client returns, an additional professional planning fee may apply.
All pricing and availability are subject to change until the applicable reservation has been confirmed and the required supplier payment has been successfully processed.
A quote, proposal, screenshot, email, itinerary, or recommendation does not guarantee price or availability.
Explore Blue Travel cannot control supplier price increases, fare changes, room availability, cabin availability, currency fluctuations, taxes, resort fees, government fees, fuel surcharges, or other supplier imposed charges.
Explore Blue Travel will not assume that the client wishes to purchase a travel arrangement merely because it appears in a proposal.
The client must provide the requested approval or booking authorization and complete all required payments before reservations can be confirmed.
Before approving travel arrangements, clients are responsible for reviewing the destination, travel dates, traveler names, room or cabin category, airfare, cancellation terms, payment deadlines, and other material details.
Once travel is booked, the applicable supplier's cancellation and change terms become binding in addition to these Terms.
Travel components are provided by independent suppliers such as airlines, hotels, resorts, cruise lines, tour operators, transportation providers, excursion companies, insurance providers, and other travel companies.
Each supplier maintains its own terms, conditions, cancellation policies, payment requirements, refund policies, and passenger contracts.
By approving a travel component, the client also agrees to the applicable supplier's terms and conditions.
Supplier terms apply in addition to Explore Blue Travel's professional planning Terms.
Land based travel may include accommodations, airfare, transportation, tours, excursions, activities, and other services.
A package presented by Explore Blue Travel may contain services provided by one supplier or several different suppliers.
Cancellation of one portion of a vacation does not automatically cancel the remaining portions.
Refund eligibility for each component depends upon the terms of the supplier responsible for that component.
A single itinerary may contain travel services purchased from several independent suppliers.
For example, airfare may be provided by an airline, accommodations by a resort, transportation by a local company, and excursions by separate tour operators.
Although Explore Blue Travel may present these components together as one vacation experience, they may remain legally and financially separate reservations.
Each component may have different deposit requirements, cancellation rules, change fees, refund policies, and travel credit policies.
Cancellation or disruption of one travel component does not guarantee that another supplier will cancel, modify, or refund its portion of the trip.
When airfare research is included in the selected planning service, Explore Blue Travel will research airfare based on the information supplied by the traveler.
Airfares can change at any time until ticketed.
Airline schedules, routing, baggage allowances, seating policies, fare rules, cancellation policies, change policies, and flight operations are controlled by the airline.
Seat requests and seating preferences are not guaranteed unless confirmed by the airline.
Airlines may change flight times, aircraft, routes, connections, or seat assignments after tickets have been purchased.
Clients are responsible for reviewing airline confirmations and verifying all traveler information immediately after ticketing.
Cruise reservations are subject to the applicable cruise line's passenger contract, fare rules, deposit requirements, final payment deadlines, cancellation penalties, and onboard policies.
Cruise lines may modify ports of call, itineraries, arrival and departure times, ships, onboard offerings, or other elements of a sailing as permitted by their passenger contracts and applicable law.
Cabin numbers, dining requests, bedding arrangements, accessibility requests, and other preferences are subject to cruise line availability and confirmation.
Clients are responsible for arriving at the embarkation port within the timeframe required by the cruise line.
Explore Blue Travel is not responsible for expenses or losses resulting from a traveler missing embarkation due to delayed flights, transportation problems, documentation issues, or other circumstances outside Explore Blue Travel's reasonable control.
Cruise travelers are responsible for complying with all cruise line identification, passport, visa, age, health, and entry requirements.
Group travel may require additional coordination, deadlines, room arrangements, payment schedules, and supplier requirements.
Explore Blue Travel may designate one person as the primary group contact.
The primary group contact is not automatically authorized to modify another traveler's individual reservation unless the traveler has provided appropriate authorization or the structure of the group agreement expressly provides otherwise.
Each traveler remains responsible for submitting requested information, completing required forms, making payments by the applicable deadlines, and reviewing their individual travel documents.
Adding or removing travelers, changing room configurations, changing departure cities, changing travel dates, or making significant modifications to a group may affect pricing, availability, group amenities, concessions, and planning fees.
Supplier group benefits may depend upon maintaining required room, cabin, or traveler minimums.
Trips created, marketed, or hosted by Explore Blue Travel may be governed by a separate Hosted Group Travel Agreement.
Hosted trips may have additional rules concerning deposits, minimum participation, roommates, group activities, conduct, cancellations, itinerary changes, payment deadlines, and host responsibilities.
When a separate Hosted Group Travel Agreement is provided, the traveler must agree to that agreement in addition to these general Terms.
Parents and legal guardians are responsible for determining and satisfying all requirements applicable to minors traveling domestically or internationally.
Requirements may include passports, identification, parental consent documentation, custody documentation, visas, cruise line documentation, or other authorization.
Hotels, cruise lines, airlines, tour operators, and destinations may impose age restrictions or occupancy requirements.
Explore Blue Travel cannot guarantee that a minor will be permitted to travel if the required documentation or authorization is not provided.
Clients are responsible for informing Explore Blue Travel of known accessibility needs or special accommodation requests relevant to their travel arrangements.
Explore Blue Travel may communicate requested accommodations to applicable suppliers but cannot guarantee that a supplier will provide or properly execute a requested accommodation.
Accessibility features, dietary requests, wheelchair services, mobility assistance, medical equipment arrangements, bedding requests, connecting rooms, and similar requests remain subject to supplier confirmation and availability.
Clients are responsible for providing complete and accurate traveler information.
Names used for airline tickets, cruise reservations, and other travel arrangements must match the traveler's required government identification or passport.
Clients are responsible for reviewing confirmations and notifying Explore Blue Travel promptly if information appears incorrect.
Costs resulting from inaccurate information supplied or approved by the traveler, including name correction fees, fare differences, supplier penalties, or rebooking expenses, are the responsibility of the traveler except where otherwise required by law.
Travelers are responsible for obtaining and maintaining all passports, visas, identification, entry authorizations, health documentation, and other documents necessary for travel.
Entry and documentation requirements can change before departure.
Travelers are responsible for confirming their continued eligibility to enter, transit through, and depart each applicable destination.
Information provided by Explore Blue Travel regarding passports, visas, immigration, health requirements, or destination entry requirements is provided for general travel planning purposes and is not legal or medical advice.
Explore Blue Travel strongly recommends that travelers consider appropriate travel insurance or travel protection.
Insurance benefits, exclusions, covered reasons, claim requirements, medical coverage, cancellation provisions, and claim decisions are controlled by the applicable insurance provider.
Purchase of travel insurance does not guarantee that a claim will be approved.
When travel protection is offered and the client declines coverage, the client accepts the financial risks associated with traveling without the declined protection.
Changes requested after travel has been confirmed may result in supplier penalties, fare differences, cancellation charges, professional service fees, or other costs.
Explore Blue Travel may charge an additional professional service fee when a requested change requires substantial additional research, rebooking, supplier communication, or reconstruction of the itinerary.
Explore Blue Travel will disclose any applicable additional professional fee before completing work outside the original scope.
Clients must notify Explore Blue Travel when they wish to cancel confirmed travel.
A request submitted to Explore Blue Travel is not considered completed until the applicable supplier cancellation has been processed or confirmed.
Supplier cancellation penalties and refund rules apply.
Cancellation of the vacation does not create a refund of Explore Blue Travel's professional planning fee.
The amount, form, eligibility, and timing of any supplier refund or travel credit are determined by the applicable supplier.
Refunds may be issued as cash, original form of payment, future travel credit, voucher, or another form permitted by the supplier.
Explore Blue Travel cannot guarantee that a supplier will issue a refund or how quickly a supplier will process one.
When a supplier processes a refund through Explore Blue Travel or another intermediary, Explore Blue Travel will process or facilitate the applicable refund according to supplier instructions and applicable law.
A supplier refund does not include Explore Blue Travel's professional planning fee unless Explore Blue Travel specifically agrees otherwise or applicable law requires otherwise.
Explore Blue Travel acts as a professional travel advisor and facilitates travel arrangements provided by independent travel suppliers.
Explore Blue Travel does not own, operate, manage, or control those suppliers.
Supplier performance is subject to the supplier's operations, policies, staffing, equipment, facilities, and contractual obligations.
Explore Blue Travel will provide reasonable assistance when supplier issues arise but cannot guarantee a particular outcome from an independent supplier.
Travel may be affected by circumstances outside the reasonable control of Explore Blue Travel or the traveler.
Such circumstances may include severe weather, hurricanes, natural disasters, war, terrorism, civil unrest, labor disputes, strikes, public health emergencies, government restrictions, border closures, airport disruptions, transportation shutdowns, supplier insolvency, destination closures, or other extraordinary events.
Explore Blue Travel will provide reasonable assistance when possible, but supplier rules and applicable law will determine available refunds, credits, changes, and remedies.
Clients are responsible for monitoring the email address and telephone number provided to Explore Blue Travel.
Explore Blue Travel may communicate proposals, payment reminders, schedule changes, documentation requests, supplier updates, and other important information electronically.
Failure to respond to time sensitive communication may result in pricing changes, loss of availability, reservation cancellation, supplier penalties, or other consequences.
Explore Blue Travel is not responsible for losses caused by a client's failure to review or respond to properly delivered communications within a reasonable time.
Explore Blue Travel reserves the right to discontinue professional planning services when a client engages in threatening, abusive, fraudulent, discriminatory, harassing, or otherwise inappropriate conduct toward Explore Blue Travel, its representatives, suppliers, or other travelers.
Any financial obligations, supplier cancellation terms, or nonrefundable professional fees that already apply will remain subject to these Terms and applicable law.
If Explore Blue Travel becomes unable to complete professional planning services because of circumstances affecting the business or assigned travel professional, Explore Blue Travel will make reasonable efforts to communicate with the client and determine an appropriate resolution.
Depending upon the circumstances and the amount of professional work already completed, possible resolutions may include transferring the planning assignment, completing portions of the work already underway, or providing an appropriate refund of unearned professional planning fees.
Nothing in these Terms is intended to permit Explore Blue Travel to retain payment for professional services that Explore Blue Travel is legally obligated to refund.
Payments may be processed by independent payment processing companies.
Explore Blue Travel may not directly store complete payment card information when payment information is transmitted and maintained by the applicable payment processor.
Clients authorize the amount clearly presented at checkout when submitting payment.
Clients are responsible for reviewing the amount before completing the transaction.
Clients are encouraged to contact Explore Blue Travel promptly regarding billing concerns so that the parties have an opportunity to review and resolve the issue.
Submitting payment confirms that the client authorized the professional planning fee displayed at checkout and requested that Explore Blue Travel begin providing the selected planning services.
Nothing in these Terms eliminates any consumer rights that cannot legally be waived.
Explore Blue Travel reserves the right to provide the payment processor, card issuer, or other applicable institution with documentation regarding the transaction, the client's acceptance of these Terms, and professional services performed when responding to a payment dispute.
Explore Blue Travel collects and uses personal information as reasonably necessary to provide travel planning and related services.
Additional information concerning the collection, use, storage, and handling of personal information is contained in the Explore Blue Travel Privacy Policy.
The Privacy Policy is incorporated by reference where permitted by applicable law.
ATTORNEY REVIEW REQUIRED
The attorney reviewing these Terms should insert appropriate language addressing limitations of liability, indirect or consequential damages, supplier acts and omissions, available remedies, and any maximum liability limitations permitted under applicable law.
This section should not be finalized without legal review because the enforceability of these provisions may depend upon applicable state law and the circumstances of a particular claim.
ATTORNEY REVIEW REQUIRED
Before publication, legal counsel should specify the governing law, jurisdiction, venue, and dispute resolution procedure applicable to Explore Blue Travel.
If Explore Blue Travel wishes to require an informal resolution process, mediation, arbitration, or another dispute resolution procedure before litigation, the attorney should draft the applicable provision and any required consumer disclosures.
Explore Blue Travel will provide required Seller of Travel disclosures applicable to transactions in jurisdictions where such disclosures are required.

Explore Blue Travel may update these Terms from time to time.
The Terms applicable to a professional planning transaction will be the version presented to the client when the client accepts the Terms and submits the applicable professional planning fee, unless the parties agree to different terms in writing.
Updates to these Terms will not retroactively alter an existing client's contractual rights or obligations except where permitted by law and appropriately agreed.
By selecting the required agreement checkbox and submitting the professional planning fee, the client confirms that they have had the opportunity to review these Terms and Conditions, understand them, and agree to be bound by them.
The client also acknowledges that travel purchases may be subject to separate supplier terms, booking authorizations, cancellation policies, passenger contracts, and other agreements.
